4. Consulting Services

A formal consulting engagement begins only when NCP Strategy and the client agree to the applicable scope of work, pricing, and other engagement terms.

Specific consulting engagements may be governed by a separate proposal, statement of work, service agreement, contract, or similar document.

If there is a conflict between these website Terms and the terms of a signed client agreement relating to consulting services, the applicable client agreement will control with respect to that engagement.

5. No Guarantee of Business Results

NCP Strategy provides strategic guidance, recommendations, frameworks, planning support, and related consulting services designed to help clients make informed business decisions and take action toward their goals.

However, business results depend on many factors outside NCP Strategy's control.

NCP Strategy does not guarantee specific financial results, revenue increases, customer growth, profitability, business performance, marketing results, funding, investment, sales, or other outcomes from using our website, resources, assessments, recommendations, or consulting services.

Clients remain responsible for their business decisions and for determining whether and how to implement recommendations provided by NCP Strategy.

6. Client and User Responsibilities

You are responsible for ensuring that information you provide to NCP Strategy is accurate and sufficiently complete for the purpose for which it is provided.

When engaging NCP Strategy for consulting services, the quality and usefulness of our recommendations may depend on the accuracy and completeness of the information provided by the client.

7. Intellectual Property

8. Client Deliverables

Ownership and permitted use of materials specifically created for a client may be addressed in the applicable proposal, statement of work, or client agreement.

Unless otherwise agreed in writing, NCP Strategy retains ownership of its pre-existing methodologies, frameworks, processes, templates, tools, know-how, and other intellectual property used in providing consulting services.

Providing a client with a deliverable does not automatically transfer ownership of NCP Strategy's underlying proprietary methodologies or intellectual property.

9. Payments

NCP Strategy may offer the ability to pay for services through the website, invoices, payment links, or third-party payment processors.

Pricing, payment schedules, deposits, cancellation terms, refunds, and other financial terms applicable to a specific consulting engagement will be communicated through the applicable proposal, invoice, service agreement, or other engagement documentation.

When payments are processed through a third-party provider, your use of that payment service may also be subject to the provider's terms and privacy practices.

16. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles.

Any disputes relating specifically to a paid consulting engagement may also be subject to dispute resolution or governing-law provisions contained in the applicable client agreement.
